Article 1:& nbsp; In order to guide enterprises to strengthen standardization work, improve their standardization level, enhance product and service quality, and promote high-quality development, this method is formulated in accordance with the Standardization Law of the People's Republic of China.
Article 2:& nbsp; The formulation and disclosure of enterprise standards, as well as the promotion, service, and supervision and management of enterprise standardization, shall be governed by these Measures.
Article 3:& nbsp; Enterprise standards are standards formulated by enterprises to coordinate and unify technical requirements, management requirements, and work requirements within the scope of the enterprise.
Article 4:& nbsp; The standardization work of enterprises should adhere to the principles of government guidance, enterprise subjectivity, innovation driven, and quality improvement.
Article 5:& nbsp; The basic task of enterprise standardization work is to implement standardization laws, regulations, and standardization outlines, plans, and policies; Implement and participate in the formulation of national standards, industry standards, local standards, and group standards, and provide feedback on the implementation of standards; Develop and implement enterprise standards; Improve the enterprise standard system, guide employees to consciously participate in the implementation of standards, conduct internal supervision of the implementation of standards, continuously improve the implementation of standards and related standardization technical activities.
Encourage enterprises to establish and improve standardization work systems, equip full-time and part-time standardization personnel, promote the application of standardization methods in production, operation and management, carry out standardization publicity and training, enhance standardization capabilities, and participate in international standard formulation.
Article 6:& nbsp; The standardization administrative departments and relevant administrative departments of the people's governments at or above the county level shall, in accordance with their respective responsibilities, strengthen guidance and supervision of enterprise standardization work, improve policy measures, and form a working mechanism for joint promotion.
Article 7:& nbsp; Enterprises should produce products and provide services according to standards.
Mandatory standards must be implemented, and enterprises are not allowed to produce, sell, import, or provide products or services that do not comply with mandatory standards. Encourage enterprises to implement recommended standards.
If there are no relevant standards for the production of products and provision of services by enterprises, enterprise standards should be formulated.
Article 8:& nbsp; The formulation of enterprise standards shall comply with the requirements of laws, regulations, and mandatory standards.
The formulation of enterprise standards should be conducive to improving economic, social, quality, and ecological benefits, achieving technological advancement and economic rationality.
Encourage enterprises to benchmark international standards and advanced standards at home and abroad, based on innovative technological achievements and good practical experience, to develop enterprise standards that exceed the technical requirements of recommended standards, and support the improvement of product quality and service level.
Article 9:& nbsp; The process of formulating enterprise standards generally includes project initiation, drafting, soliciting opinions, review, approval for publication, re examination, and cancellation.
Article 10:& nbsp; When enterprises need to refer to or cite materials when formulating standards, they shall comply with relevant national regulations on intellectual property rights.
References or citations to international standards and domestic and foreign standards shall comply with relevant copyright regulations.
Article 11:& nbsp; Encourage enterprises to integrate industrial chain, supply chain, and innovation chain resources, and jointly develop enterprise standards.
Article 12:& nbsp; The product or service standards formulated by enterprises shall specify the testing methods, inspection methods, or evaluation methods.
The experimental methods, inspection methods, or evaluation methods shall refer to the corresponding national standards, industry standards, or international standards. Without corresponding standards, enterprises can develop their own testing methods, inspection methods, or evaluation methods. The testing methods, inspection methods, or evaluation methods independently developed by enterprises shall be scientific, reasonable, accurate, and reliable.
Article 13:& nbsp; The enterprise standards implemented by enterprises in providing products or services shall be numbered according to unified rules. The numbering of enterprise standards consists of the enterprise standard code, enterprise code, sequence number, and year number in sequence.
The enterprise standard code is "Q", which can be composed of Chinese Pinyin letters, Arabic numerals, or a combination of both.
& nbsp; Enterprise standards jointly developed with other enterprises shall be numbered and published in the form of enterprise standards.
Article 14:& nbsp; The country implements a system of self declaration, disclosure, and supervision of enterprise standards. Enterprises shall publicly disclose the numbers and names of mandatory standards, recommended standards, group standards, or enterprise standards that they implement in providing products or services.
Enterprises that implement self formulated or jointly formulated enterprise standards shall disclose the functional indicators and performance indicators of products and services, as well as the corresponding testing methods, inspection methods, or evaluation methods. If laws, regulations, and mandatory national standards have other provisions on restricting excessive packaging of goods, enterprises shall disclose the packaging standards they adopt in accordance with relevant regulations.
If the functional and performance indicators disclosed by the enterprise are less than or lower than the recommended standards, they should be clearly stated in the self declaration disclosure.
The products produced and services provided by enterprises shall comply with the technical requirements of the enterprise's public standards.
Article 15:& nbsp; Enterprises should complete the self declaration and disclosure of the execution standard information before providing products or services. For commissioned processing and production of products or provision of services, the commissioning party shall complete the self declaration and disclosure of the execution standard information.
When there are changes in the implementation standards of the enterprise, the content of the self declaration should be updated in a timely manner. After the enterprise completes the cancellation registration, the relevant enterprise standards should be abolished.
Article 16:& nbsp; Encourage enterprises to publicly declare themselves through the national unified enterprise standard information public service platform.
If self declaration is made public through other channels, the public channels should be clearly stated on the national unified enterprise standard information public service platform, and the information disclosed in the self declaration should be accessible, traceable, and tamper proof.
Article 17:& nbsp; The country establishes a standard innovative enterprise system. Encourage enterprises to build a technology, patent, and standard linkage innovation system.
Article 18:& nbsp; The standardization administrative departments and relevant administrative departments of the people's governments at or above the county level shall support enterprises to participate in professional standardization technical organizations, encourage enterprises to participate in the formulation of national standards, industry standards, local standards or group standards.
Article 19:& nbsp; The state encourages enterprises to carry out evaluation of the effectiveness of standard implementation and provide feedback on standard implementation information to the institutions that formulate national standards, industry standards, local standards, and group standards.
Enterprises developing new products, improving products, and conducting technological transformations should evaluate and update the relevant enterprise standards they have formulated.
Article 20:& nbsp; The standardization administrative departments and relevant administrative departments of the people's governments at or above the county level shall support enterprises in carrying out pilot demonstration projects for standardization, encourage the creation of good standardization behaviors in enterprises, and establish industry development benchmarks.
Article 21:& nbsp; The country implements the "leader" system for enterprise standards, promoting enterprises with independent innovation technology, advanced technology, and good implementation benefits to become the "leaders" in the industry.
Article 22:& nbsp; The country implements a standard financing credit enhancement system. Encourage social capital to establish special funds to support enterprise standard innovation in a market-oriented manner, encourage and support financial institutions to provide credit support to enterprises with high standardization levels, and support eligible enterprises to carry out standard transactions, standard pledges, and other activities.
Article 23:& nbsp; The state encourages enterprises to compare international standards and advanced foreign standards, continuously carry out benchmarking and compliance activities, and improve the quality competition level of enterprises.
Article 24:& nbsp; The standardization administrative departments and relevant administrative departments of the people's governments at or above the county level shall support enterprises to participate in international standardization exchanges and cooperation, encourage enterprises to participate in the work of technical institutions of international standard organizations, and participate in the formulation of international standards.
Article 25:; The state encourages enterprises, universities, research institutions, and social organizations to carry out standardized professional and technical services, improve the socialization and marketization level of standardized services, and serve the standardization work of enterprises.
Article 26:& nbsp; The state encourages higher education institutions, research institutions, and other units to offer standardized courses or majors, and strengthen the education of standardized talents in enterprises.
The standardization administrative departments and relevant administrative departments of the people's governments at or above the county level shall guide enterprises to improve the standardization talent training mechanism.
Article 27:& nbsp; The standardization administrative departments and relevant administrative departments of the people's governments at or above the county level shall increase the reward for enterprise standards that have independent innovative technologies, play a leading and exemplary role, and generate significant economic and social benefits in accordance with relevant regulations. Support the inclusion of advanced enterprise standards in the scope of scientific and technological awards.
Enterprises and individuals who have made significant achievements in standardization work shall be commended and rewarded in accordance with relevant regulations.
Article 28:& nbsp; The standardization administrative departments and relevant administrative departments of the people's governments at or above the county level shall supervise and inspect the standards implemented by enterprises in providing products or services in accordance with the law through a "double random, one open" supervision method. Special supervision and inspection can be carried out for special key areas.
Article 29:& nbsp; Enterprises that refuse to provide information or provide false information during supervision and inspection shall be ordered to make corrections; Those who refuse to make corrections shall be notified or announced by the standardization administrative department of the people's government at or above the county level.
Article 30:& nbsp; If an enterprise fails to disclose the standards for the products and services it provides, the standardization administrative department of the people's government at or above the county level shall order it to make corrections within a specified period of time; Those who fail to make corrections within the prescribed time limit shall be publicly announced on the enterprise standard information public service platform.
Article 31:& nbsp; If the enterprise standards formulated by the enterprise do not comply with the provisions of Article 8 (1), Article 8 (2), and Article 12 of these Measures, the standardization administrative department of the people's government at or above the county level shall order it to make corrections within a specified time limit; If the enterprise fails to make corrections within the prescribed time, the standardization administrative department of the people's government at or above the provincial level shall abolish the enterprise standard and publicize it on the enterprise standard information public service platform.
Article 32:& nbsp; If the enterprise standards formulated by the enterprise do not comply with the provisions of Article 13 of these Measures, the standardization administrative department of the people's government at or above the county level shall order it to make corrections within a specified time limit; If the correction is not made within the prescribed time, the standardization administrative department of the people's government at or above the provincial level shall revoke the relevant standard number and publicize it on the enterprise standard information public service platform.
Article 33:& nbsp; If an enterprise's self declaration does not comply with the provisions of Article 14, Article 15, and Article 16 of these Measures, the standardization administrative department of the people's government at or above the county level shall order it to make corrections within a specified period of time; Those who fail to make corrections within the prescribed time limit shall be publicly announced on the enterprise standard information public service platform.
Article 34:& nbsp; If an enterprise engages in other illegal activities as stipulated in these Measures during the process of standard setting, self declaration and public disclosure, it shall be dealt with in accordance with relevant laws and administrative regulations. If there are no provisions in laws and administrative regulations, the standardization administrative department of the people's government at or above the county level may urge them to make corrections through sending warning letters, interviews, and other means; Those who fail to make corrections within the prescribed time limit shall be publicly announced on the enterprise standard information public service platform.
Article 35:& nbsp; If laws and administrative regulations have other provisions on enterprise standardization work, follow those provisions.
Article 36:& nbsp; These measures shall come into effect on January 1, 2024. The "Enterprise Standardization Management Measures" promulgated by the former State Administration of Technical Supervision on August 24, 1990, were simultaneously abolished.
